Terms and Conditions

By subscribing to Club Ducks, you are agreeing to the following terms and conditions. 

According to the Copyright Act 1968 No. 63 the Customer must not reverse compile, disassemble, remove, release, disclose, reveal, copy, extract, modify or otherwise reverse engineer all or any part of the Club Ducks software, documentation or data. 

1. Payment of Fees The Customer will pay Club Ducks Pty Ltd the then applicable fees described in the subscription details. Club Ducks Pty Ltd reserves the right to change the Fees and to institute new rates upon thirty (30) days prior notice to the Customer (which may be sent by email)
2. Term and Termination Annual subscription shall be automatically renewed each additional year unless the customer decides otherwise.Upon any termination, Club Ducks Pty Ltd will make Customer Data available to the Customer in a form Club Ducks Pty Ltd deems appropriate for a period of thirty (30) days, but thereafter the Club Ducks Pty Ltd may, but is not obligated to, delete stored Customer Data. 
3. Warranty and Disclaimer Club Ducks platform is provided "as is". Club Ducks makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further Club Ducks does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site. 
4. Limitation on liability in no event shall Club Ducks be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Club Ducks website.
5. This Agreement is the complete and exclusive statement of the mutual understanding of the parties.  No agency, partnership, joint venture, or employment is created as a result of this Agreement and the Customer does not have any authority of any kind to bind Club Ducks Pty Ltd in any respect whatsoever.
6. All notices under this Agreement will be deemed to have been duly given when subscription to Club Ducks is purchased and confirmed.
